The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Goshoppi. You further consent that the terms and contents of such Privacy Policy are acceptable to you. It is our policy to respect your privacy regarding any information we may collect from you within the framework of our privacy policy.

Terms And Conditions

Goshoppi reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend / cancel, or discontinue any or all service at any time without notice, add new services, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. Such changes will be posted to the Terms of Service page for your convenience. You are responsible for regularly reviewing these Terms of Service so that you will be apprised of any changes. You will be deemed to have accepted such change(s) if you continue to access the Site subsequent to posting of such changes.

Registartion

If you create an account on Goshoppi, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account.

Goshoppi requires you to register as a User by creating an Account in order for you to engage in certain activities allowed by the site. You will receive a password and account designation upon completing the site's registration process. You will be responsible for maintaining the confidentiality of the password and the account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Goshoppi of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

Goshoppi will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Goshoppi may contain content containing technical inaccuracies, typographical mistakes, and other errors. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Goshoppi disclaims any responsibility for any harm resulting from use by users.

Order Processing and Delivery

Goshoppi strives to provide it’s customers with an efficient and easy to use order and delivery      service.                                                                                                                                                                         

The Buyers can order the products in any of the following ways:

- Website

- Mobile Apps

Goshoppi strives to sell products that are available in directly accessible  own inventory or from registered merchants. Goshoppi also has partnered with multiple local vendors to bring you products that are not directly sourced from our own inventory. In such cases, our partnered merchants are responsible for delivery of items ordered and Goshoppi does not take responsibility for any delays or failures or deficiencies in delivery of such items by the respective merchant(s). However in such cases of delays or failures or deficiencies, Goshoppi will coordinate with the vendors and arrange to pass on the refunds received from the vendor(s) to the customer.

Price and Payment

We aim to ensure that prices of all products are correct and up-to-date. However, from time to time, prices for certain products may not be current or may be inaccurate on account of technical issues, typographical errors or incorrect product information provided to the Company by a supplier. In each such case, notwithstanding anything to the contrary, the Company and the seller both reserve the right to cancel the order without any further liability. Subject to the foregoing, the price mentioned at the time of ordering a product shall be the price charged at the time of delivery, provided that no product listed on the Marketplace will be sold at a price higher than its MRP (Maximum Retail Price).

Currently, we don’t allow payment through the credit card; the buyers shall make payment directly to the Supermarket only through “Cash on Delivery”.

Refund Or Cancellation

Orders once placed through Goshoppi are full and final. Goshoppi will not issue refunds for any orders that are placed and have been shipped or delivered to the customer in a reasonably timely manner. Where orders have not been delivered, or the delivered item(s) are defective, the customer will be refunded the full amount of the item(s) or order in question. We understand that sometimes orders are placed by mistake. If the customer notifies us immediately to request cancellation of such orders, Goshoppi may process the cancellation on a case-by-case basis contingent upon whether or not the respective merchant(s) accept(s) such a cancellation.

Contents Posted On Site

You are responsible for any notes, messages, e-mails, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files or other materials or information posted or transmitted to the Sites (collectively, "Content"). Such Content will become the property of Goshoppi throughout the universe. Goshoppi shall be entitled to, consistent with our Privacy Policy, use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include Content you provide. You agree that any Content you post may be used by Goshoppi, consistent with our Privacy Policy and Rules of Conduct on Site as mentioned herein, and you are not entitled to any payment or other compensation for such use.

Content Posted On Other Websites

We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites, mobile applications, domains, services, tools and webpage’s (collectively known as ‘non-Goshoppi sites’)to which Goshoppi.ae links, and that link to Goshoppi.ae. Goshoppi does not have any control over those non-Goshoppi sites, and is not responsible for their contents or their use. By linking to a non-Goshoppi site, Goshoppi does not represent or imply that it endorses such a non-Goshoppi site. Goshoppi disclaims any responsibility for any harm resulting from your use of non-Goshoppi sites and webpage’s.

Privacy Policy

Intellectual Property

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Goshoppi owns all Intellectual Property Rights relating to “Goshoppi”, its related sub-domains, mobile applications, sites, services and tools, and trademarks relating to "Goshoppi" including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, meta tags, databases, text, content, graphics, icons, hyperlinks, etc. You acknowledge and agree that you shall not use, reproduce or distribute any content from “Goshoppi”, its related sub-domains, mobile applications, sites, services and tools belonging to Goshoppi without obtaining authorization from Goshoppi.

Notwithstanding the foregoing, it is expressly clarified that you will solely be responsible for any content that you provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which may be accessible through your post, or any other content that you upload, transmit or store when using the site.

Copyright Infringement

As Goshoppi asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to Goshoppi.ae  violates your copyright, you are encouraged to notify Goshoppi. Goshoppi will respond to all such notices, which may include as required or appropriate removing the infringing material or disabling all links to the infringing material. In case any user infringes the copyrights or other intellectual property rights of Goshoppi or others, Goshoppi may, in its discretion, terminate or deny access to and use of the site. In the case of such termination, Goshoppi will have no obligation to provide a refund of any amounts previously paid to Goshoppi.

Termination

Goshoppi may terminate your access to all or any part of the site at any time, with or without cause, with or without notice. If you wish to terminate this Agreement or your Goshoppi account (if you have one), you may simply discontinue using Goshoppi. In addition, Goshoppi can terminate the service immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature shall survive termination, including, without limitation, ownership provisions, intellectual property rights, warranty disclaimers, indemnity and limitations of liability. If you or Goshoppi terminates your use of the site, Goshoppi may delete any content or other materials relating to your use of the Site, its related sub-domains, mobile applications, sites, services and tools and Goshoppi will have no liability to you or any third party for doing so.

Disclaimer Of Warranties

Goshoppi, its related sub-domains, mobile applications, sites, services and tools are provided “as is”. Goshoppi and its suppliers, licensors, and merchants hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Goshoppi nor its suppliers, licensors, and merchants makes any warranty that the Goshoppi, its related sub-domains, mobile applications, sites, services and tools will be error free or that access thereto will be continuous or uninterrupted.

The user understands and agrees that any material and/or data downloaded or otherwise obtained through the site is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

Limitation Of Liability

In no event will Goshoppi, or its suppliers, licensors, or merchants be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement of substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the amounts paid by you to Goshoppi under this agreement in respect of the order under dispute. Goshoppi shall have no liability for any failure or delay due to matters beyond our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

General Representation And Warranty

You represent and warrant that your use of the site will be in strict accordance with the Goshoppi Privacy Policy, with this Agreement and with all applicable laws and regulations.

Indemnification

You agree to indemnify and hold harmless Goshoppi, its contractors, merchants, licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of Goshoppi, including but not limited to your violation of this Agreement.

User Obligations

You agree and undertake to use Goshoppi only to post and upload material that is proper. By way of example, and not as a limitation, you agree and undertake that when using the site, you will not:

·       Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others

·       Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword

·       Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents

·       Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the site or another's computer

·       Conduct or forward surveys, contests, pyramid schemes or chain letters

·       Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner

·       Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded

·       Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service

·       Violate any applicable laws or regulations for the time being in force in UAE.

·       Violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the site contained elsewhere herein and

·       Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the site.

·       Notwithstanding anything to contrary, Goshoppi’s entire liability to you shall be the refund of the money charged from you for any specific Voucher or Order, under which the unlikely liability arises. Under no circumstance shall Goshoppi be liable for any consequential, indirect or remote loss that you or your friends and family may suffer.

Usage Conduct

·       You shall solely be responsible for maintaining the necessary computer equipments and Internet connections that may be required to access use and transact on Goshoppi.

·       You are also under an obligation to use Goshoppi for reasonable and lawful purposes only, and shall not indulge in any activity that is not envisaged through Goshoppi.

·       You shall use Goshoppi, and any voucher/coupons purchased through it, for personal, non-commercial use only and shall not re-sell the same to any other person.

Electronic Communication

You agree that we may communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Goshoppi requires your agreement during the registration process to send you promotional emails to let you know about any new changes, features or promotional activities added to the Site. If, at any time, you decide that you do not wish to receive promotional emails, you can opt out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.

Withdrawal Of Access And/Or Membership

Without prejudice to any other rights and remedies of Goshoppi under this User Agreement or at law or otherwise, Goshoppi may limit, suspend or withdraw your membership and / or your access to the Site at any time, without notice, for any reason, including without limitation, breach of this User Agreement.

Governing Law And Jurisdiction

This User Agreement is governed by, and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason. This User Agreement is subject to the jurisdiction of Dubai Courts.
